17188 Rocky Ridge Road Deed to Perpetual Easement
That we, A.W. Brill, Jr., and wife, Kathleen Brill of Travis County, Texas is in consideration of One Dollar ($1.00) cash and other valuable considerations to us in hand, paid by O.H. Cullen and wife, Mattie Make Cullen of Travis County, Texas receipt of which is hereby acknowledged and for which no lien, either expressed or implied is retained or shall exist, have sold, granted and conveyed and by these presents do sell, grant and convey subject to the hereinafter restrictions, easements and reservations, all that certain lot, tract or parcel of land out of the W.J. Jolley Survey NO. 54, Travis County, Texas and being known as Lot No. 7 in Arno Brill Second Subdivision Lake Travis, Travis County, Texas, according to the plat of said Second Subdivision out of that certain tract of land surveyed by A.H. Sylvester and wife, Emma Sylvester to A.W Brill, Jr., dated March 15, 1944 recorded in the Deed Records of Travis County, Texas, Book 712, pp126-127 said Lot No. 7 being described by metes and bounds as follows:
Beginning at the N.E. corner of said Lot No. 7 which point is the W. line of Boundary _________ thence N, 85* __’ __227.6 feet to stake for corner; thence S 10* 50’N. 65.54 feet to stake for corner; thence ________ corner of said Lot No. 7 on Boundary Road Thence N 16* 31’__ with the W. line of Boundary Road 113.95 feet to the place of beginning.
To have and to hold the above described tract of land together with all appurtenances thereto, subject to the hereinafter restrictions, easements and reservations, unto the said O.H. Cullen and wife, Mattie Mae Cullen their heirs and assigns forever. And we do hereby bind ourselves, our heirs, executors and administrators to warrant and forever defend unto the said O.H. Cullen and wife, Mattie Mae Cullen their heirs and assigns the right and title to all and singular the above described property against the lawful claim or claims of any person forever.
This deed is executed upon the condition that the grantees herein, their heirs and assigns shall not place upon the adjacent land below the 715 foot contour line any fence or building of any kind, other than boat dock or docks and that they, their heirs and assigns shall not use the above described tract of land, or any part thereof, or the adjacent land below the 715 foot contour line, for any business or commercial purpose, or as a place to sell drinks of any kind or sandwiches, lunches or meals, or as a place to rent boats, or to sell, give or furnish fish bait, but these restrictions to not include the right to fish, hunt or to use and enjoy said tract of land as a place of recreation. These restrictions shall be inserted in each subsequent deed executed by the grantors herein for tracts of land out of the W.J. Jolly Survey No. 54, Travis County, Texas.
An easement of right of way over and above conveyed and described lot of land not to exceed twenty feet in width is hereby reserved unto the grantors, their heirs and assigns along and parallel with the 715 foot contour line above mean sea level as established by the United States Geological Survey bench marks, said right of way to be selected and described by A.W. Brill, Jr.
